CC&Rs: HOA board member in charge of CC&R enforcement, Alyssa Lenicka, reviewed selected CC&Rs, purpose, and common violations, highlighting:

Front and backyard maintenance / appearance

Parking rules, including for guests, and never in front of mailboxes

Dog barking (anyone can call Sheriff’s dept)

Pet owners must remove pet waste from common areas
-
Use of trash bins (Alyssa Lenicaka/Luke Hedtke and Paul/Mollie De Korte are volunteering to empty these biweekly)

Community garden policies (in SW corner for homeowners only)

Community landscaping / sidewalk maintenance (contractor does this)

Common Areas: Beth Blair led a discussion on the use of these, and reminded members to contact the board with any questions pertaining to these.

Issued raised by attendees and addressed by the board:

Traffic markings on the road at the Sutton Place entrance are fading due to constructions vehicles; repainting these would be handled by the county.

Construction vehicles for apartment complex are now using the back, gravel egress, not the paved entrance to Sutton Place to reduce dirt/wear/traffic.

Potential removal of the dog waste bin near the mailboxes due to requests by postal officer.

2022 Operating Budget and Financial Report: presented by Beth Blair

Budget was mailed to all homeowners with Annual Meeting announcement

2021 unpaid dues: Board will move into placing liens on ten properties

2022 Dues: 19 properties are delinquent
-
Expect a dues increase, as ours are below what is recommended and are not allowing us to maintain adequate reserves for future projected costs

Board will look at implementing the option to pay dues electronically, possibly through the HOA website

Irrigation update: presented by board member Paul De Korte

Paul reviewed:

who owns what portions of our shared irrigation system, which is shared with 3 other HOAs, and who to contact when there is an issue with the communal portions:

Irrigation district

Stimac

Stimac owns the main pump, but eventually the motor will need to be replaced by the HOAs, and the cost is ~$80-$100k
-

Homeowners are responsible for their own irrigation system on their property, and for replacing/repairing breaks.

Because of clay soil, it is recommended that lawns are watered more frequently for shorter amounts of time (2-3 minutes)
-
Homeowners are responsible for blowing out their own systems each year
-

Common area fence painting

CCRs states HOA is responsible for sealing by 2024 initially, annd every five years thereafter

We plan to have them sealed sooner in order to avoid the cost of replacing them due to warping, which has already begun

Our annual bill for Board liability insurance is due in April: $765.90.

Michael Cole motions to approve and pay the insurance.

Bethany seconded the motion.

Motion passed to pay the Board liability insurance bill for the period: 04/05/2023 – 04/05/2024.

We have spent more than $500 in office supplies and budgeted for $300.
-
Landscaping: this is going up because of inflation and additional areas that the current company did, but was not included in the contract. They want to include it if we renew the contract, and thus will charge more.

HOA Dues will need to go up due to inflation, increased costs of landscaping, and office supplies for all the notice mailers.

Legally we are required to have a certain level in reserves.

More people who opt in to electronic consent will lower our admin expenditures.

Mailbox update: Bethany Eichler

Bethany spoke to US Postal Service officer about getting a mailbox for the HOA attached to the community area with address number: 472 S Kansas Loop.

They were going to call back the next day but never did.

Bethany will go back to the post office and follow up.

Our annual fee for our UPS mailbox is due in March.

Dog waste bag container key:

We never received one so Beth will call the company to see whether we can get a key issued.

If not, as an alternative, Paul will put a lot in himself.

After passing of bylaws, the Board must create a Schedule of fees and fines.

HOA Mailbox: UPS is increasing rent for our mailbox

Beth suggested we check with USPS to see whether we can get a mailbox added for the empty 472 lot, as we were able to add a trashbin under that address.

Michael will ask USPS about this on Nov. 21 while at Post Office

UPS cost is hundreds a year, so this would be a good cost savings

UPS box is currently paid/leased through April

Beth Blair circulated a draft of proposed by-laws for board members to review prior to our January meeting

Michael made three suggestions he agreed to send via email.

All board members will send all suggestions to secretary via email by Jan 9, 2023.

Fence quote: painting company came today to give a quote; they would be available to start Tuesday, September 27, 2022; we need to choose a stain color.

We have the funds to cover this until a special assessment can be collected

A house recently sold in our development had never paid dues, so these were collected upon the sale (2021 and 2022 dues and 12% late fees)

2022 Election ballot verification and Results

Reviewed written notices received via the HOA address, from all homeowners designating voters for multi-owner properties:

Received 2 notices from owners of multi-owner properties

Received 1 notice for a property that has a sole owner

Opened all 8 sealed envelopes received by mail at the HOA address:

All votes were valid

The legally required 20% quorum (13 votes) was not reached.

Discussion: Beth noted that she has been acting treasurer since Will Gant, the former treasurer, sold his home, and Michael Cole is an accountant and highly qualified for the role.

Paul DeKorte, appearing by telephone, voted in favor of electing Michael Cole as treasurer.

Beth Blair, Bethany Eichler and Michael Cole all voted in favor as well.

Common Areas Update
-
Landscaping:
-
Beth volunteered to be point of contact with the HOA’s landscaping company, since Alyssa Lenicka previously volunteered in this role.
-
Beth arranged for invoices to be emailed to the HOA email address in lieu of Alyssa’s email address.
-

Pet waste update
-
Beth discovered that the communal walkway has a physical address, so was able to open a Waste Management account for the HOA. The cost is $45/month.
-
This alleviates the need for board members to include the pet waste in their own trash bins.
-
Michael Cole will update the budget to reflect this decreased monthly fee for waste removal.
-

Irrigation
-
Beth confirmed 2022 taxes have now been paid.

Notices
-
Late dues: Notices can be mailed on August 1st. The board agreed to send late notices to all fourteen (14) delinquent units/homeowners for 2022 HOA Dues.

2021 lien proceeding: the board agreed to move forward with the lien process on all five (5) delinquent units/homeowners for 2021 HOA Dues.

Sutton Place Bylaws
-
Sutton HOA currently has no bylaws.
-
Beth provided a partial draft of potential bylaws which she drafted based on other local bylaws.
-
Board needs to review the draft bylaws to provide feedback and discuss at the next board meeting.

Fence Staining
-
We need to get quotes; Alyssa Lenicka was heading this up so the board will do additional research. Specifications are: Fourth Street side of fence (outside) and outside of all common areas, and no rain within 72 hours and not below a certain temperature (to confirm).

Other business: Open Floor to HOA member questions

Bethany noted that she currently doesn’t have access to meeting minutes for the Annual Meeting or Executive Session due to a broken laptop; repairs are expected by early August. We will therefore have to vote on those minutes at the next meeting.

Validity of election:

Bethany cited relevant laws and CC&Rs indicating that so many of the votes counted at our May 17, 2022 annual meeting were by proxies and not in accordance with CC&Rs, that we did not reach a quorum.

Consensus was reached that the vote was invalid, and options to move forward were proposed and discussed.

The board discussed the next steps and a timeline for holding a new election:
